Anti-Soviet agitation and propaganda have been recognised as acts that present no public danger, and those convicted of them are subject to rehabilitation regardless of the factual soundness of the charge, the Presidium of the Supreme Court of the Russian Federation has stated, having examined the case of a resident of Odesa convicted in 1950 of treason against the Motherland and counter-revolutionary agitation.

While living in occupied territory, Ivan Mok voluntarily served as village elder in a settlement and carried out the instructions of the Fascist invaders. After repatriation, while in the Kirov Region, he conducted anti-Soviet agitation among the local population.

The Supreme Court of the Russian Federation set aside the judicial decisions in respect of the punishment for counter-revolutionary agitation, leaving unchanged the sentence for treason against the Motherland.
